1. Acceptance of Terms

By downloading, accessing, or using the Takke application ("App") or website ("Service"), you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Service.

We reserve the right to modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the modified Terms.

2. Service Description

Takke is a food and grocery delivery platform that connects users with local restaurants, cafes, bakeries, and grocery stores in the Nabatieh region of Lebanon. Our Service includes:

• Browsing menus and products from partner establishments
• Placing orders for delivery or pickup
• Real-time order tracking
• Secure payment processing
• Customer support

Takke acts as an intermediary platform. We are not a restaurant, food preparation service, or delivery company. We facilitate connections between users, partner establishments, and independent delivery drivers.

3. User Accounts

3.1 Account Registration

To use certain features of our Service, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information as needed
• Keep your password secure and confidential
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account

3.2 Account Eligibility

You must be at least 16 years old to create an account. By using our Service, you represent that you meet this requirement and have the legal capacity to enter into these Terms.

3.3 Account Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or any other reason at our discretion.

4. Orders and Payments

4.1 Placing Orders

When you place an order through Takke:

• You are making an offer to purchase from the partner establishment
• The order is subject to acceptance by the partner
• Prices displayed are set by partner establishments and may vary
• Menu items and availability are subject to change without notice

4.2 Pricing

All prices displayed include applicable taxes unless otherwise stated. Additional charges may include:

• Delivery fees (based on distance and demand)
• Service fees
• Small order fees (for orders below minimum threshold)

4.3 Payment

We accept the following payment methods:

• Cash on delivery (COD)
• Credit/Debit cards (where available)
• Mobile payment solutions (where available)

By providing payment information, you authorize us to charge the applicable amounts for your orders.

4.4 Order Cancellation

You may cancel an order within a limited time window before the partner begins preparation. Cancellation policies:

• Full refund if cancelled before order is accepted
• Partial or no refund once preparation begins (at our discretion)
• No refund after order is dispatched for delivery

5. Delivery

5.1 Delivery Areas

Our Service is currently available in the Nabatieh governorate, Lebanon. Delivery availability depends on your location and partner coverage.

5.2 Delivery Times

Estimated delivery times are provided as guidance only. Actual delivery times may vary due to:

• Order volume and complexity
• Traffic and weather conditions
• Partner preparation time
• Driver availability

We are not liable for delays beyond our reasonable control.

5.3 Delivery Instructions

You are responsible for providing accurate delivery addresses and contact information. If delivery cannot be completed due to incorrect information or unavailability, additional charges may apply.

6. User Conduct

You agree not to:

• Use the Service for any unlawful purpose
• Provide false or misleading information
• Harass, abuse, or threaten drivers, partners, or staff
• Attempt to manipulate ratings or reviews
• Use automated systems or bots to access the Service
• Interfere with or disrupt the Service
• Violate any applicable laws or regulations
• Resell items purchased through the Service

7. Intellectual Property

All content on the Takke platform, including but not limited to logos, graphics, text, software, and design, is the property of MJ Tech S.A.R.L. or our licensors and is protected by intellectual property laws.

You may not copy, modify, distribute, or create derivative works from our content without express written permission.

8. Disclaimers

8.1 Service "As Is"

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

• Merchantability or fitness for a particular purpose
• Uninterrupted or error-free operation
• Accuracy or reliability of information

8.2 Partner Products

Takke does not prepare food or products. We are not responsible for:

• Food quality, taste, or presentation
• Allergen information accuracy
• Compliance with dietary requirements
• Partner hygiene or food safety practices

Please communicate any allergies or dietary requirements directly through the app or to the partner.

9. Limitation of Liability

To the maximum extent permitted by law, MJ Tech S.A.R.L. and its officers, directors, employees, and agents shall not be liable for:

• Indirect, incidental, special, or consequential damages
• Loss of profits, data, or business opportunities
• Personal injury or property damage arising from your use of the Service
• Any third-party conduct or content

Our total liability shall not exceed the amount you paid for the specific order giving rise to the claim.

10. Indemnification

You agree to indemnify and hold harmless MJ Tech S.A.R.L. from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Lebanese Republic. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Lebanon.

12. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

13. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and MJ Tech S.A.R.L. regarding the use of our Service.
